User agrees to defend, indemnify and hold harmless Fotodiox Inc. against liabilities arising out of:
(1) Failure to execute an order due to lags or inaccuracies in available product inventory
(2) Failure to execute an order due to non-execution of deliveries by the our suppliers.
(3) The destruction of products upon receipt due to damage incurred during transit
(4) Any injury to person or property caused by any product sold or otherwise distributed in connection with Fotodiox Inc.
Fotodiox Inc. shall be the sole judge of what violates this policy. |
